Privacy Policy and Terms of Use 

All personal information is collected in compliance with section 33 of Alberta’s Freedom of Information and Protection of Privacy Act (FOIP). Information is only viewed by authorized personnel for the purpose of providing the requested service. 

1 Acceptance of Terms 

This Terms of Use Statement applies to the Invest Olds/e-Services website (“the site”), owned and operated by the Town of Olds. By accessing and using the site, you agree to be subject to the terms and conditions described in this document. If you do not agree to these terms of use, do not use this site. The Town of Olds reserves the right to update this Terms of Use Statement at any time without prior notice to you. 

In addition, you will be subject to any posted guidelines or terms applicable to our services, which may be revised from time to time. All such guidelines or rules are hereby incorporated by reference into these Terms of Use. 

2 Visitor Tracking 

This site tracks users anonymously. It also uses cookies. The information collected is used to evaluate visitors’ use of the site and to compile statistical reports on website activity. You may disable or prevent the use of cookies using your chosen web browsing software. Please note that disabling cookies may interfere with the normal operation of the site. 

3 External Sites and Services 

The Town of Olds is not responsible for the content and privacy practices of other web sites and encourages you to examine the terms of use, privacy policy and disclaimer of each site and make your own decisions regarding the disclosure of your personal information and the use of that site. 

4 Security Measures 

The Town of Olds employs network security measures to monitor for attempts to tamper with information, or to otherwise cause damage. Please be aware that any attempt to damage our systems will be pursued to the maximum extent of the law. 

5 Description of Services 

You understand and agree that the Site is provided “as is,” and that the Town of Olds and its authorized agents and contractors assume no responsibility for the timeliness, deletion, mis-delivery, or failure to store any user communications or personalization settings. 

6 Transaction Currency 

All transactions on the site are conducted in Canadian currency only (CAD). 

7 Your Obligations 

When using the site, you agree to provide true, accurate, current and complete information about yourself as prompted by various forms and update your information as needed to keep it true, accurate, current, and complete. Any false, inaccurate or misleading information will be considered a breach of these terms of use. 

You, not the Town of Olds or its authorized agents and contractors, are solely responsible for all content (i.e., information, data text, software, music, sound, photographs, graphics, video or messages or other) you upload, post, email or otherwise transmit. 

You agree to use the site only for the purpose of obtaining information about the programs and services offered by the Town of Olds.  You agree not to use the site for any illegal activities.  

8 Communications 

The Town of Olds may send emails, contact you via telephone, or send you mail via postal service as part of the online services that you use, as well as to inquire or inform you of your account activity. You may also be contacted using the methods mentioned above to inform you about important information and changes to this site. 

9 No Warranties 

The information about the programs and services offered by the Town of Olds is provided “as is” without warranty of any kind, including warranty of fitness for a particular purpose.  The Town of Olds does not warrant the accuracy or the completeness of the Online Services, or that the Online Services will function without error, failure or interruption. The Town of Olds and its authorized agents and contractors assume no liability or responsibility for any errors or omissions in the content or operation of the Site. 

10 Limitation of Liability 

No action may be brought by any person or entity against the Town of Olds for any loss or damage of any kind caused by any reason or purpose including, without limitation, reliance on the functioning of the site. 

11 Account Password and Security 

Certain services may require a password and account designation. You are responsible for maintaining the confidentiality and security of your password. You are solely responsible for all activities that occur under your account. You agree to immediately notify the Town of Olds of any unauthorized use of your password or account or any other breach of security. The Town of Olds and its authorized agents and contractors will not be liable for any loss or damages arising from your failure to comply with this section. 

12 Intellectual Property 

The Town of Olds reserves its rights in all intellectual property contained in the site. You are advised that The Town of Olds will aggressively enforce its intellectual property rights to the fullest extent of the law, which may include, without limitation, the seeking of criminal prosecution. 13 Copyright Information 

You should assume that everything you see or read on the Site is copyright-protected unless otherwise noted, and may not be used except as provided in these Terms of Use. All other use shall require the written permission from the Town of Olds, its authorized agents and contractors, or such third party that may own the materials. The Town of Olds neither warrants nor represents that your use of materials displayed on the Site will not infringe rights of third parties not owned by or affiliated with The Town of Olds. 

13.1 Use of Images 

Images of people or places displayed on the Site are either the property of, or used with permission by, the Town of Olds. The use of these images by you, or anyone else authorized by you, is prohibited unless specifically permitted by these Terms of Use. Any unauthorized use of the images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. 

13.2 Termination 

The Town of Olds and its authorized agents and contractors reserve the right at any time, to modify or discontinue, temporarily or permanently, the Site (or any part thereof) with or without notice for any reason or no reason whatsoever. You agree that The Town of Olds and its authorized agents and contractors shall not be liable to you or any third party for any modification, suspension or discontinuance of the Site. 

14 Governing Law 

These Terms of Use are governed by and interpreted in accordance with the laws in force in Alberta Canada, and you agree and submit to the exclusive jurisdiction of courts in Alberta Canada. You and the Town of Olds agree to submit to the personal and exclusive jurisdiction of the provincial and federal courts located within the Judicial District of Calgary, Alberta for any disputes or matters arising out of the Site or use of the Site.
